Foreword
The origins of the English legal system can be found in a number of places. These include historical and documentary sources or within the legal system itself.
Consideration of historical sources involves the study of the roots of a particular rule of law. This enables one to ascertain where and how that rule originated and the manner in which it has evolved until it was embodied in some way in the present legal system. This necessitates an understanding of both the common law and equity.
Examination of the legal sources requires examination of the actual legal authority for a proposition of law. In the main the sources for this are statutes and precedents and to a minor extent, custom and other minor sources of law.
This module introduces students to the most commonly found sources of English law having frequent application to the building and construction industry.
